Paying for Your Order

Generally, we'll charge your payment method for an item when we ship the item to you or confirm its availability in store. However, we may preauthorize your order amount with your credit card, credit account, or debit card issuer at the time you place the order, which may have an effect on your available credit line. When you pre-order with a debit card, we'll debit your card when you place the pre-order. For special delivery items, we'll charge your payment method when you confirm a delivery time.

Order Confirmation

While we will use our best efforts to fulfill all orders, The Golfer's World cannot guarantee the availability of any particular product displayed on the The Golfer's World Site. Our order confirmation to you does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. If we reject, limit, or otherwise modify your order, we will attempt to promptly notify you using the email address you provide to us. If we cancel an order or part of an order that we've already charged you for, we'll refund you the full amount of the canceled portion of the order. The Golfer's World aggressively enforces its intellectual property rights to the fullest extent of the law. The name of The Golfer's World, TGW, or any of The Golfer's World's trademarked product names; the The Golfer's World logo or the logo of any The Golfer's World trademarked product names; or the other The Golfer's World formatives may not be used in any way, including in advertising or publicity pertaining to distribution of materials on this NTE Site, without prior, written permission from The Golfer's World. The Golfer's World strictly prohibits use of the The Golfer's World logo as part of a link to or from any site unless establishment of such a link is approved in advance by The Golfer's World in writing. Fair use of The Golfer's World's Marks requires proper acknowledgment. Other product and company names mentioned on this The Golfer's World Site may be the Marks of their respective owners.

The Golfer's World offers its customers marketing and promotional mobile alerts (e.g. cart reminders) by text message (the "Service") on 87439. Signing Up and Opting-In to the Service

Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. Only United States mobile numbers are eligible to participate. You may not enroll if you are under 18 years old. Before the Service will start, you will need to agree to these Terms. The Golfer's World reserves the right to stop offering the Service at any time with or without notice. The Golfer's World also reserves the right to change the short code, phone number, or RCS agent from which messages are sent, and we will notify you when we do so.

By opting into the Service, you:

A. Authorize The Golfer's World to send recurring text messages, which may be automated or AI-generated, to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in) at any time and frequency.

B. Acknowledge that you do not have to agree to receive messages as a condition of purchase.

C. Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.

D. Consent to the use of an electronic record to document your opt-in. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access, and (ii) and either a printer or storage space on such device. For an email copy, you'll also need an email account you can access from the device, along with a browser or other software that can display the emails.

Once you affirm your choice to opt-in to the Service on 87439, the timing and frequency of messages may vary based on your interactions and initiated texts. You may receive alerts about:

The Golfer's World and the mobile carriers are not responsible for any undue delays, failure of delivery, or errors in messages.

To Stop the Service

To stop receiving text messages from The Golfer's World, text the word STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to 87439 any time or reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to any of the text messages you have received from The Golfer's World. You can also contact us at cs@tgw.pure.cloud. These are the exclusive methods for opting out. After opting out, you will receive one additional message confirming that your request has been processed.

For any content that you submit, you grant The Golfer's World and its authorized third-party service providers a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content (including photos and all data contained or appended to the computer file of such photos) that you submit may be used and shared with authorized third-parties at The Golfer's World's sole discretion. The Golfer's World reserves the right to change, condense or delete any content on the The Golfer's World Site that The Golfer's World deems, in its sole discretion, to violate these Terms. The Golfer's World does not guarantee that you will have any recourse through The Golfer's World to edit or delete any content you have submitted. Disputes

You agree that this agreement and your use of the The Golfer's World Site are governed by the laws of the State of Minnesota, USA. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Dakota County, Minnesota, USA in all disputes (a) arising out of, relating to, or concerning the The Golfer's World Site and/or these Terms; (b) in which the The Golfer's World Site and/or these Terms present is an issue of a material fact; (c) in which the The Golfer's World Site and/or these Terms are referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization; (d) arising out of relating to any products or services sold or distributed by The Golfer's World whether in store, in your home, over the phone, or online; and (e) related to The Golfer's World's advertising, communication, delivery, or sales practices relating to its products and services. Use of the The Golfer's World Site is unauthorized in any jurisdiction that does not give full effect to all provisions of these Terms, including without limitation this paragraph and the warranty disclaimers and liability exclusions.

The Golfer's World has endeavored to comply with all legal requirements known to it in creating and maintaining the The Golfer's World Site, but makes no representation that materials on the The Golfer's World Site are appropriate or available for use in any particular jurisdiction. Use of the Site is unauthorized in any jurisdiction where all or any portion of the The Golfer's World Site may violate any legal requirements and you agree not to access the The Golfer's World Site in any such jurisdiction. You are responsible for compliance with applicable laws. Any use in contravention of this provision or any provision of these Terms is at your own risk and, if any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.

WITH THE PRIOR AGREEMENT OF THE GOLF WAREHOUSE OR PLAY BASEBALL, ANY CLAIM, DISPUTE OR CONTROVERSY ARISING OUT OF, RELATING TO OR CONCERNING THIS SITE AND/OR THIS AGREEMENT SHALL BE DECIDED BY BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION AND ANY SUCH ARBITRATION PROCEEDINGS SHALL BE BROUGHT AND HELD IN DAKOTA COUNTY, MINNESOTA, USA. CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PURPORTED REPRESENTATIVE OF ANY CLASS. THE DECISIONS OF THE ARBITRATORS SHALL BE BINDING AND CONCLUSIVE UPON ALL PARTIES INVOLVED AND JUDGMENT UPON ANY AWARD OF THE ARBITRATORS MAY BE ENTERED BY ANY COURT HAVING COMPETENT JURISDICTION. THIS PROVISION SHALL BE SPECIFICALLY ENFORCEABLE IN ANY COURT OF COMPETENT JURISDICTION.

General

You agree that The Golfer's World may at any time and without notice change the terms, conditions and notices under which the The Golfer's World Site are offered; however, any change to the terms after your last usage of the The Golfer's World Site will not be applied retroactively.

You agree that no joint venture, partnership, employment or agency relationship exists between you and The Golfer's World as a result of this agreement or your use of this The Golfer's World Site.

The Golfer's World's performance of these Terms is subject to existing laws and legal process and nothing contained in this agreement is in derogation of The Golfer's World's right to comply with law enforcement requests or requirements relating to your use of the The Golfer's World Site or information provided to or gathered by The Golfer's World with respect to such use.

These Terms, the Privacy Policy, and terms of sale constitute the entire agreement between you and The Golfer's World with respect to the The Golfer's World Site. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and The Golfer's World with respect to this The Golfer's World Site. No modification of this agreement shall be effective unless it is authored by The Golfer's World or its affiliates. Any alleged waiver of any breach of this agreement shall not be deemed to be a waiver of any future breach. A printed version of this agreement and/or of any notice given by The Golfer's World in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms or your use of this The Golfer's World Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by The Golfer's World in printed form.
